This website is operated by WangSpec. Throughout the site, the terms “we”, “us” and “our” refer to WangSpec. WangSpec offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Data Retention: Customer account and order data are retained for up to twenty-four (24) months for order history, warranty, and licensing verification, consistent with our Privacy Policy and applicable GDPR/CCPA standards, after which they may be deleted or anonymized as described in that policy.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied.

This includes but is not limited to all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

To the maximum extent permitted by applicable law, in no event shall WangSpec, its affiliates, or their respective officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, savings, data, goodwill, or other intangible losses, whether incurred directly or indirectly, resulting from:

(a) your use of or inability to use any product or service,
(b) any unauthorized access to or use of our servers and/or any personal information stored therein,
(c) any interruption or cessation of service,
(d) any bugs, viruses, or harmful components transmitted via our Service,
(e) any errors or omissions in content, or
(f) any other matter relating to the Service or any product.

Except in cases of gross negligence or willful misconduct, WangSpec’s total aggregate liability under these Terms—whether in contract, tort (including negligence), or otherwise—shall not exceed the greater of (a) the total amount paid by you for the specific product giving rise to the claim, or (b) USD $100. This limitation applies to the fullest extent permitted by law and is intended to provide a minimum recoverable amount in consumer jurisdictions.

Product Warranties
Certain WangSpec products include a limited or lifetime warranty as described in our Warranty Policy.
This warranty outlines coverage, exclusions, and claim procedures. If there is any conflict between the Warranty Policy and these Terms, the Warranty Policy will govern.

Digital Products and Downloads:

Due to the nature of digital goods, all sales are final once a download is initiated. Refunds or replacements will only be issued for verified technical defects or undeliverable files reported within seven (7) days of purchase.

If you experience technical issues accessing digital files, notify WangSpec within this timeframe for resolution support.

WangSpec actively monitors for unauthorized reproduction or distribution of its digital assets and reserves the right to pursue enforcement actions, including DMCA takedowns or legal proceedings, in response to verified infringement.

Because some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages, the above limitations may not apply to you, but will apply to the fullest extent permitted by law.

Off-Road and Racing Use Only:

Unless explicitly stated otherwise, all WangSpec products are intended for off-road and closed-course competition use only. They are not certified for public road use and may not comply with federal, state, or local emissions or safety regulations.

Installation or use of these products on vehicles operated on public roads may violate applicable laws and void your vehicle manufacturer’s warranty. The purchaser and end user assume full responsibility for ensuring compliance with all legal requirements in their jurisdiction.

This disclaimer is prominently displayed on relevant product pages and confirmed again during checkout to ensure clear and conspicuous disclosure in accordance with FTC guidelines.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless WangSpec, its parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of:

(a) your breach of these Terms of Service or any referenced policies;
(b) your violation of any law, regulation, or third-party right;
(c) your misuse or unauthorized use of WangSpec products, services, or digital assets; or
(d) any intellectual-property infringement claim or allegation resulting from your modification, reproduction, or commercial use of WangSpec’s digital files or proprietary data.

This indemnification applies only to the extent permitted by applicable law and shall not exceed the greater of (a) the total amount paid by you for the product or service in question or (b) USD $100. Nothing in this Section requires indemnification for WangSpec’s gross negligence or willful misconduct.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service remain effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site.

We reserve the right to suspend or terminate your access to our Services, in whole or in part, at any time if, in our reasonable judgment, you:
(a) violate these Terms of Service or any related policies;
(b) engage in fraudulent, abusive, or unlawful activity; or
(c) act in a manner that could harm WangSpec’s operations, customers, or reputation.

Upon termination, you remain responsible for all charges incurred up to the effective termination date. WangSpec may deny future access to its Services if necessary to protect the business or comply with applicable law.

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict-of-law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Multnomah County, Oregon. By using our Services, you agree to submit to this jurisdiction and waive any objection to such venue.

This venue selection and waiver apply primarily to business-to-business transactions.

For consumer purchases, this jurisdiction clause does not waive your rights under applicable federal or state consumer protection laws, including your right to bring claims in your home jurisdiction where permitted by law.

Both parties agree to attempt to resolve any dispute informally and in good faith before proceeding to formal legal action.

Your continued use of or access to our website or the Service following the posting of any changes constitutes acceptance of those modifications.

All transactions are governed by the version of the Terms of Service in effect at the time the order was placed.

SECTION 20 – DIGITAL PRODUCTS – LICENSE AND USAGE TERMS

The following terms apply specifically to all digital products sold by WangSpec LLC, including but not limited to STL files, 3D scans, CAD references, and downloadable mesh data. 

1. Single-User License:
   All digital product purchases are licensed to a single individual customer. This license is non-transferable and is intended for personal or internal development use only. Unless otherwise stated in writing, no commercial resale, sublicensing, or redistribution is permitted.
   
   
2. Watermarking and File Tracking:
   Digital files may contain embedded watermarking (visible or invisible) that identifies the license holder. Unauthorized distribution, resale, or public use of these files may result in enforcement actions, including DMCA takedowns or legal action. WangSpec enforces watermarking in good faith and only where clear evidence of unauthorized distribution exists.
   
   
3. Refunds for Digital Goods:
   Due to the nature of digital goods, all sales are final once a download is initiated. Refunds or replacements will only be issued in cases of verified technical defects or undeliverable files. If you experience technical issues accessing digital files, you must notify WangSpec within 7 days of purchase to qualify for support or replacement.
   
   
4. Accuracy Disclaimer:
   Digital scans are provided as-is for visual reference or non-critical design use. While created using real-world capture methods, WangSpec LLC makes no guarantees as to dimensional accuracy, fitment, or suitability for mechanical, safety-critical, or commercial use. These files are intended for conceptual or motorsports development use only. Customers must independently verify suitability before any mechanical or safety-critical use.
   
   
5. Intellectual Property Rights:
   All digital content remains the sole property of WangSpec LLC. By purchasing and downloading a product, you agree not to duplicate, republish, or reverse-engineer the content for resale or redistribution.
   
   
6. Legal Jurisdiction:
   These digital product terms are governed by the laws of the State of Oregon and are subject to the same dispute resolution terms defined in Section 18.
   
   
7. Third-Party Components Disclaimer:
   Some scans may include third-party or aftermarket components that were physically installed on the item during capture. WangSpec LLC does not claim ownership or licensing rights to these components, and their inclusion is incidental. All trademarks and product designs remain the property of their respective owners. Any brand names are used solely for identification or compatibility reference under fair-use principles. These files are not affiliated with or endorsed by any third-party brand unless explicitly stated.
8. Updates & Versioning: WangSpec may release updated versions of digital files. Unless explicitly stated on the product page at time of purchase, updates are not included. At our discretion, we may provide minor revisions or replacement links as goodwill. Major updates may be offered at a discounted upgrade price for prior customers.

Free Digital Downloads

Free digital files provided by WangSpec LLC are subject to the same intellectual property protections as paid digital products.

These files are provided for personal, non-commercial use only, unless otherwise explicitly stated.

By downloading any free file from this website, you agree that:

• You will not resell, redistribute, or share the file publicly
• You will not use the file for commercial production or sale
• You acknowledge that the file is provided “as-is” with no guarantees of performance, fitment, or safety
• You assume all responsibility for any use, modification, or installation of the file

WangSpec LLC reserves the right to revoke access to free downloads and pursue enforcement actions in cases of misuse or unauthorized distribution.

SECTION 21 – FORCE MAJEURE
Neither party shall be liable for any delay or failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, labor disputes, power or internet outages, cyber-attacks, data breaches, governmental actions, war, terrorism, epidemics, or failures of third-party carriers or suppliers. Performance shall be excused for the duration of the force majeure event, and deadlines shall be extended for a commercially reasonable period thereafter.
